Terms of Hire.

We pride ourselves on hitting the brief and creating great content. However, to ensure you’re 100% happy with your experience with us, please read the following terms of hire carefully. 

 Note: By reading the following Terms of Hire, you accept the terms and conditions contained herein:

 Copyright © is retained by Filmsy Media and Jason Hocking for all photo and video content captured and delivered by Filmsy Media and its agents or employees.

  • Copyright © is retained by Filmsy Media and all photo and video content captured and delivered are licensed to you (the vendor) for non-exclusive use only. (Please see usage rights sections for more information) 

  • All photo and video content is licensed to one end user (client), be it an individual or a business. 

  • Filmsy Media holds the right to use any and all photo and video content for self promotional purposes via print and online platforms and may use photo or video content for other clients without notice. 

  • Filmsy Media holds the right to resell photo or video content at a later date to other individuals and/or businesses without requiring permission.

(Note: Exclusive rights license agreements are available upon request)

Usage Rights:

By using our services, you agree to enter into a non-exclusive end-user license agreement. Meaning all photo or video content can only be used for the intended purpose agreed upon by Jason Hocking and/or an authorised Filmsy Media represented.

Individuals who illegally use photo or video content created by Filmsy Media and its agents or employees will be required to pay for licensing in order to continue using the content. Failure to make payment on a license will result in all content needing to be taken offline and removed from all advertising material immediately. Compensation may also be payable. 

Filmsy Media also holds the right to resell photo or video content at a later date to other individuals and/or businesses without requiring written permission. We do not accept any responsibility or liability for any legal disputes or potential misrepresentations made by our photo or video content.

Real Estate Terms:

  •  All real estate photo and video content will accurately portray the subject property to the best of our ability. This may include; room size, colour balance and brightness. 

  • All properties will be captured in as-is condition and no photo or video content will be extensively manipulated or edited to remove items, enhance items or otherwise mislead persons.

  • For hygienic and safety reasons, staff are not permitted to move/re-arrange furniture or other personal items. 

 Limitation of Liability:

  • Filmsy Media is not liable for any loss, damage, or expense arising from the use of its services, including but not limited to errors, omissions, or inaccuracies with any products or services.

  • The client is responsible for verifying the accuracy and completeness of all provided products and services before using it for marketing purposes.

  • Filmsy Media does not accept any responsibility or liability for any legal disputes or potential misrepresentations made by any products or services.

Delivered Terms: 

  • All photos will be delivered fully edited in “high-resolution” jpeg format - unless otherwise requested.

  • All video content will be delivered colour-graded, edited and up to 4k in resolution - unless otherwise requested.

  • Delivery of all final media will be made via internet transfer of the sender’s choice.

  • All edit/re-edit requests must be made in writing within 72 hours of proof being provided. Addition edits may be charged at $20 per image or $110 per hour.

 

Cancellation policy: 

  • All booking cancellations must be confirmed via phone call, text or email. 

  • If a shoot is cancelled without warning (for example the property is inaccessible or unpresentable) a cancellation fee of $75 may be applied. 

  • In the event that the weather is extremely poor and unworkable, no charge will be applied and the shoot will be rescheduled to the next available session time.

 

Payment:

  • All invoices will be sent via email with Direct Deposit being the preferred method of payment.

  • All invoices must be paid within 14-days of the invoice being issued.
